INTRODUCTION These Terms & Conditions ("Terms") govern your access to and use of HoopsBoom, including our website, applications, prediction services, Premium services, content, features, communications, Telegram Bot, referral programme, and related services (collectively, the "Services"). The Services may include: • Basketball predictions • Free basketball predictions • Premium basketball predictions • Match analysis • Basketball statistics • Recent results • Live match information • Head-to-head information • Last-five-game information • Prediction confidence information • Booking codes • Bookmaker-related information • Premium subscriptions • Referral programmes • Telegram Bot services • Promotional content • Other basketball-related features HoopsBoom is a sports information, prediction, and analysis platform. HOOPSBOOM IS NOT A SPORTSBOOK. HoopsBoom does not operate a betting wallet for users and does not hold users' betting balances or betting winnings. HoopsBoom does not accept bets on behalf of users. Where a user chooses to place a bet, the transaction takes place with the relevant third-party bookmaker or betting service, subject to that third party's terms, rules, and policies. 3. ACCEPTANCE OF THESE TERMS By creating an account, accessing the Services, purchasing a Premium subscription, using a booking code, participating in the referral programme, linking your Telegram account, or otherwise using HoopsBoom, you confirm that: • You have read these Terms. • You understand these Terms. • You agree to comply with these Terms. • You agree to our Privacy Policy. • You are legally permitted to use the Services in your jurisdiction. If you do not agree with any part of these Terms, you must stop using the Services. 4. ELIGIBILITY You may use HoopsBoom only if you are legally permitted to do so under the laws applicable to you. You are responsible for determining whether access to sports betting-related information, predictions, bookmaker links, booking codes, or related services is lawful in your location. HoopsBoom does not guarantee that the Services are appropriate, available, or lawful in every jurisdiction. You must not use HoopsBoom where doing so would violate applicable law or regulation. 5. ACCOUNT REGISTRATION Certain features require you to create a HoopsBoom account. When registering, you agree to provide accurate and current information. You are responsible for: • Maintaining accurate account information. • Protecting your login credentials. • Maintaining the confidentiality of your account. • All activity occurring through your account, subject to applicable law. • Informing us promptly if you believe your account has been compromised. EMAIL VERIFICATION AND ACCOUNT SECURITY Certain account features may require email verification. HoopsBoom may send verification, security, authentication, password-reset, and other account-related communications to the email address associated with your account. FREE AND PREMIUM ACCESS HoopsBoom may provide both Free and Premium access. Free users may receive access to selected basketball predictions and other features determined by HoopsBoom. Premium users may receive additional content and functionality, including access to Premium predictions and booking codes. Free users may be able to see that Premium predictions exist while the actual prediction and booking code remain locked. The availability, quantity, and configuration of Free and Premium content may change as HoopsBoom develops its Services. Premium access does not guarantee any particular prediction outcome, profit, return, or betting result. 8. PREMIUM SUBSCRIPTIONS Premium subscriptions provide access to Premium features for the applicable subscription period. The exact Premium plans, prices, billing intervals, and available features are displayed to users before purchase. By purchasing a Premium subscription, you authorize the applicable payment process for the amount presented at checkout. Premium access begins according to the applicable subscription and payment rules. HoopsBoom may change Premium pricing or plans in the future. Where required by applicable law, users will receive appropriate notice of material changes. 9. SUBSCRIPTION RENEWALS Where a Premium plan is configured as a recurring subscription, the subscription may renew according to the billing interval displayed at the time of purchase. The applicable renewal amount and billing period will be presented to you before or during the subscription process. You are responsible for ensuring that your payment method remains valid where recurring billing applies. If automatic renewal is available, you may cancel it through the available account or subscription controls before the applicable renewal date. 10. FAILED PAYMENTS If a Premium subscription payment fails, HoopsBoom may: • Attempt payment again where supported. • Temporarily restrict Premium access. • Mark the subscription as past due. • Cancel or expire the subscription if payment remains unsuccessful. The exact handling of failed payments may depend on the payment provider and subscription configuration. HoopsBoom is not responsible for payment failures caused by circumstances outside our reasonable control, including insufficient funds, expired payment methods, bank declines, payment-provider failures, or incorrect payment information. 11. PAYMENT PROCESSING Payments may be processed through third-party payment providers. When you make a payment, the applicable payment provider may process payment and billing information according to its own terms and privacy policy. HoopsBoom does not guarantee the uninterrupted availability of any particular payment provider. A payment is considered successfully completed only when the applicable payment system confirms the transaction. 12. CRYPTOCURRENCY PAYMENTS Where cryptocurrency payments are supported, users may be required to complete payment within a specified payment period. A crypto payment may expire if the required payment is not completed within the applicable payment window. If a crypto payment expires, the user may be required to initiate a new payment. Blockchain transactions may be irreversible. Users are responsible for verifying: • The correct payment amount. • The correct cryptocurrency or token. • The correct payment address. • The applicable payment network. • Any applicable transaction requirements. HoopsBoom is not responsible for losses caused by sending funds to an incorrect address, using an unsupported network, sending an incorrect asset, or otherwise failing to follow the payment instructions provided. 13. REFUNDS Refund eligibility is subject to the applicable subscription, payment, and refund policy displayed at the time of purchase and applicable law. Where a refund is legally required, HoopsBoom will process it in accordance with applicable law. We may not be able to reverse blockchain transactions once confirmed. Where a third-party payment provider processes the payment, the refund may also be subject to that provider's processing procedures. HoopsBoom does not guarantee refunds for periods of Premium access already used unless required by applicable law or expressly stated otherwise. 14. PREDICTIONS AND SPORTS ANALYSIS HoopsBoom provides basketball predictions, analysis, statistics, and related information for informational and entertainment purposes. Predictions are opinions, assessments, or analytical outputs based on available information and should not be interpreted as guarantees. Sports outcomes are uncertain. A prediction may be incorrect even where it is presented with a high confidence percentage. Past performance does not guarantee future results. 15. NO GUARANTEE OF WINNING HoopsBoom does not guarantee: • Winning bets. • Profitable betting. • Successful booking codes. • Successful bookmaker transactions. • Any particular return. • Any particular prediction accuracy. • Any particular prediction success rate. Any confidence percentage displayed by HoopsBoom represents the platform's prediction or analytical assessment and does not represent a guarantee of the actual match outcome. Users remain solely responsible for any decisions they make based on information provided through HoopsBoom. 16. PREDICTION RESULTS Prediction results may be determined using available match and sports data. Results may be affected by: • Data-provider delays. • Incorrect or incomplete data. • Match postponements. • Match cancellations. • Competition rules. • Official result changes. • Data-feed errors. • Differences between bookmaker settlement rules and sports-data results. Where appropriate, HoopsBoom may update a prediction result after additional information becomes available. 17. LIVE MATCH INFORMATION HoopsBoom may display live match information. Live information may be delayed, incomplete, or temporarily unavailable. HoopsBoom does not guarantee that live scores, statistics, match status, or other live information will always be real-time or error-free. Users should not rely on HoopsBoom live information as the sole source for time-sensitive betting decisions. 18. BASKETBALL DATA HoopsBoom may obtain basketball data from third-party data providers. This may include: • Fixtures • Teams • Leagues • Scores • Results • Statistics • Standings • Head-to-head information • Recent games • Live match information • Historical information Third-party data may contain errors or omissions. HoopsBoom may correct or update information when reliable updated information becomes available. 19. BOOKMAKERS HoopsBoom may display information relating to bookmakers. The actual bookmakers available through the platform may change. A bookmaker displayed on HoopsBoom does not automatically mean that HoopsBoom has a formal partnership with that bookmaker. An "Official Bookmaker" designation will only be used where an applicable commercial relationship or approved designation exists. Bookmakers operate independently from HoopsBoom. 20. BOOKING CODES HoopsBoom may provide bookmaker booking codes associated with particular predictions. A booking code may be associated with: • A specific prediction. • A specific bookmaker. Booking codes may initially be entered manually by HoopsBoom administrators. HoopsBoom does not guarantee that every booking code will: • Remain valid indefinitely. • Remain available. • Be accepted by the bookmaker. • Contain exactly the same selections after bookmaker changes. • Be available in every jurisdiction. • Remain valid after a bookmaker changes its systems or rules. Users should verify the booking code and selections with the relevant bookmaker before placing any transaction. 21. BOOKMAKER TERMS When using a bookmaker through a link, booking code, affiliate link, or other pathway provided by HoopsBoom, you are dealing directly with that bookmaker. The bookmaker's: • Terms and conditions • Privacy policy • Betting rules • Eligibility requirements • Withdrawal rules • Settlement rules • Promotional terms • Geographic restrictions may apply. HoopsBoom is not responsible for a bookmaker's independent decisions, systems, account restrictions, settlement decisions, payment processing, or service availability. 22. RESPONSIBLE USE Sports betting involves financial risk. Users should never bet money they cannot afford to lose. ADVERTISEMENTS HoopsBoom may display banner advertisements and promotional content. An advertisement does not constitute an endorsement or guarantee of the advertised product or service unless expressly stated. 25. TELEGRAM BOT HoopsBoom may provide a Telegram Bot that allows users to access or receive HoopsBoom content. Users may be required to link their Telegram account to their HoopsBoom account. Access to Telegram content may depend on the user's HoopsBoom account status, including Free or Premium status. The Telegram Bot may provide different content according to the user's access level. Telegram is an independent third-party platform. Your use of Telegram is subject to Telegram's own terms, policies, and privacy practices. 26. PREMIUM TELEGRAM ACCESS Premium Telegram users may receive Premium prediction information and booking codes where the applicable feature is enabled. Free Telegram users may see match or selection context while Premium prediction details and booking codes remain locked. HoopsBoom may change Telegram features, commands, delivery methods, or access rules as the Services develop. 27. REFERRAL PROGRAMME HoopsBoom may offer a referral programme. Where available, users may receive referral benefits for eligible referrals that satisfy the applicable programme conditions. Referral qualification may depend on criteria established by HoopsBoom. HoopsBoom may: • Determine whether a referral qualifies. • Reject fraudulent or abusive referrals. • Investigate suspected referral manipulation. • Reverse rewards obtained through fraud or abuse. • Change referral programme rules where legally permitted. Referral rewards are not guaranteed merely because a user shares a referral link. 28. REFERRAL ABUSE Users must not attempt to manipulate the referral programme. PROHIBITED ACTIVITIES You must not use HoopsBoom to: • Violate applicable laws. • Commit fraud. • Impersonate another person. • Access another user's account without authorization. • Circumvent Premium access controls. • Attempt to obtain locked Premium predictions without authorization. • Extract or scrape HoopsBoom content in a manner prohibited by law or our policies. • Reverse engineer protected systems where prohibited by law. • Interfere with the operation of the Services. • Introduce malware or malicious code. • Conduct automated attacks. • Abuse referral systems. • Manipulate prediction results or platform data. • Circumvent security mechanisms. • Resell HoopsBoom Premium content without authorization. 30. PREMIUM CONTENT AND INTELLECTUAL PROPERTY HoopsBoom and its content, branding, software, design, graphics, text, prediction presentation, logos, interfaces, and other original materials are owned by or licensed to BEEPS TELEKOM ENTERPRISES, except where otherwise indicated. You may use HoopsBoom content for your personal, lawful use of the Services. You must not reproduce, redistribute, sell, republish, commercially exploit, or systematically copy Premium content without authorization. This includes unauthorized redistribution of: • Premium predictions. • Booking codes. • Premium analysis. • HoopsBoom proprietary content. • Screenshots or copied content used for commercial redistribution. 31. USER-GENERATED CONTENT If HoopsBoom allows users to submit comments, feedback, messages, reviews, or other content, you are responsible for the content you submit. You must not submit content that: • Is unlawful. • Is fraudulent. • Infringes intellectual-property rights. • Contains malicious code. • Harasses or threatens others. • Contains unauthorized personal information. • Violates applicable law. By submitting content where a submission feature is provided, you grant HoopsBoom the permissions reasonably necessary to host, display, process, and operate the feature. 32. SERVICE AVAILABILITY We aim to keep HoopsBoom available and reliable. However, we do not guarantee that the Services will always be: • Available. • Uninterrupted. • Error-free. • Free from delays. • Free from technical problems. • Compatible with every device. • Available in every location. Maintenance, updates, technical failures, third-party failures, security incidents, network problems, and other circumstances may temporarily affect availability. 33. SERVICE CHANGES HoopsBoom may add, modify, suspend, or remove features. This may include changes to: • Predictions. • Premium features. • Free features. • Booking codes. • Bookmakers. • Telegram functionality. • Referral programmes. • Subscription plans. • User interfaces. • Data sources. • Advertisements. Where required by applicable law, we will provide appropriate notice of material changes. 34. ACCOUNT SUSPENSION OR TERMINATION HoopsBoom may suspend or terminate an account where permitted by law if we reasonably believe that the user: • Violated these Terms. • Engaged in fraud. • Abused the Services. • Attempted unauthorized access. • Manipulated the referral programme. • Circumvented Premium restrictions. • Created multiple fraudulent accounts. • Used the Services unlawfully. • Created a security or operational risk. Where appropriate and legally required, we may provide notice or an opportunity to address the issue. 35. EFFECT OF TERMINATION If your account is suspended or terminated: • Access to Premium content may end. • Telegram access may be disconnected. • Referral benefits may be restricted. • Booking-code access may end. • Other account features may become unavailable. Termination does not automatically remove obligations that by their nature should continue after termination. 36. DISCLAIMER OF WARRANTIES To the maximum extent permitted by applicable law, HoopsBoom provides the Services on an "as available" and "as is" basis. We do not guarantee that: • Predictions will be accurate. • Sports data will always be correct. • Booking codes will always work. • Third-party bookmakers will remain available. • Live information will always be instantaneous. • The Services will always operate without interruption. • Premium content will produce any particular financial outcome. 37. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law, BEEPS TELEKOM ENTERPRISES and HoopsBoom will not be responsible for losses arising from: • Betting decisions made by users. • Incorrect predictions. • Lost bets. • Missed betting opportunities. • Incorrect or delayed third-party sports data. • Invalid or expired booking codes. • Bookmaker decisions. • Bookmaker account restrictions. • Third-party payment failures. • Cryptocurrency transaction errors. • Network failures. • Third-party service outages. • Unauthorized access caused by the user's failure to protect credentials. • Events outside our reasonable control. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law. 38. Nothing in these Terms is intended to remove or restrict any mandatory legal rights that cannot lawfully be excluded. 46. Where a dispute cannot be resolved directly, the parties may pursue any remedies available under applicable law. 47. SEVERABILITY If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable where legally possible. The remaining provisions will continue in effect. 48. NO WAIVER If HoopsBoom does not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later. 49. ENTIRE AGREEMENT These Terms, together with the Privacy Policy and any additional terms expressly applicable to specific HoopsBoom features, constitute the agreement between you and HoopsBoom concerning your use of the Services. Where a specific feature has additional terms, those terms will apply to that feature in addition to these Terms. 50. CHANGES TO THESE TERMS We may update these Terms from time to time.
